General Provisions 1.1. Operator: These General Terms and Conditions regulate the rights and obligations between LOYA s.r.o., with its registered office at Železničná 345/47, Teplička nad Váhom, ID No. (IČO): 53 975 812, Tax ID (DIČ): 2121536769, registered in the Commercial Register of the District Court Žilina, Section: Sro, File No. 77781/L (hereinafter referred to as the "Seller") and physical or legal persons purchasing goods through the Seller's online store at www.loyasport.eu (hereinafter referred to as the "Buyer"). 1.2. Agreement: By using the online store, the Buyer agrees to these General Terms and Conditions. 1.3. Legal Framework: Legal relations not regulated by these GTC are governed by the applicable laws of the Slovak Republic, in particular Act No. 40/1964 Coll. Civil Code, the Consumer Protection Act in distance selling, and the E-commerce Act. 2. Orders 2.1. Ordering Method: The Buyer may place an order: via the e-shop at www.loyasport.eu, via email at support@loyasport.eu. 2.2. Details: The order must contain accurate details of the Buyer (full name, delivery address, phone number, email, and company ID/Tax ID if applicable). 2.3. Binding Nature: The order becomes binding upon its confirmation by the Seller via email. 2.4. Control: The Buyer is obliged to check the details in the order and confirm their accuracy. 2.5. Promotions: For orders within special promotions (e.g., volume discounts, bundles), the order is considered a single unit. In case of withdrawal from the contract, the entire bundle must be returned (all items from the package). 3. Delivery Terms 3.1. Delivery Method: The Seller delivers goods via courier service or postal service to the address specified in the order. 3.2. Delivery Time: * Goods in stock: 1 – 5 business days. Goods in external warehouse: 2 – 3 weeks. Pre-orders: 7 – 90 business days (see section 3.3). 3.3. Pre-orders: The estimated delivery date is for information purposes only and may change. By purchasing a pre-order, the Buyer agrees to a potential delay. The Buyer will be informed of any significant delays. 3.4. Receipt: The Buyer is obliged to check the shipment upon receipt. In case of visible damage to the packaging, it is necessary to write a damage protocol directly with the carrier. 4. Price and Payment Terms 4.1. VAT: All prices are stated including VAT. 4.2. Payment Methods: Payment by card via a secure system or bank transfer. 4.3. Shipping: Shipping costs are charged separately according to the price list published on the e-shop website. 4.4. Price Changes: The Seller reserves the right to change prices depending on changes in supplier prices or market conditions. 5. Ownership Acquisition 5.1. Receipt: The Buyer is obliged to take delivery of the goods at the address specified in the order. 5.2. Risk of Damage: The risk of accidental destruction or deterioration of the goods passes to the Buyer at the moment of receipt. 5.3. Ownership: Ownership rights to the goods pass to the Buyer only after full payment of the purchase price. 6. Withdrawal from the Contract 6.1. Deadline: The Buyer has the right to withdraw from the contract without giving a reason within 30 days of receipt of the goods. 6.2. Method: Withdrawal can be exercised in writing to the registered office address or by email at support@loyasport.eu. 6.3. Bundles: For promotional sets and volume discounts, it is necessary to return all items of the bundle together in case of withdrawal. 6.4. Refunds: The Seller will refund the money (including delivery costs to the customer) within 14 days of receipt of the returned goods. For card payments, the refund is processed to the same card (the bank process takes 5 – 10 business days). 6.5. Hygiene: Withdrawal is not possible for goods sealed in protective packaging that are not suitable for return due to health protection or hygiene reasons if the protective packaging was broken after delivery. 7. Complaints and Warranty 7.1. Warranty Period: All sold goods are covered by a statutory 24-month warranty period. 7.2. The warranty does not cover: Mechanical damage caused by the Buyer, improper use contrary to the manual, improper maintenance, or normal wear and tear. 7.3. Filing a Complaint: By email at support@loyasport.eu or in writing to the address of LOYA s.r.o. 7.4. Requirements: The returned goods must be accompanied by a claim form, proof of purchase (invoice), and a precise description of the defect. 7.5. Processing Time: The complaint will be processed within 30 days of its submission. 8. Alternative Dispute Resolution (ADR) 8.1. Right to Redress: The Buyer has the right to request out-of-court dispute resolution through entities for alternative dispute resolution, e.g., the Slovak Trade Inspection (www.soi.sk) or the ODR platform (www.ec.europa.eu/odr). 9. Final Provisions 9.1. Validity: These GTC are valid from January 1, 2026. 9.2. Changes: The Seller reserves the right to change these conditions. The current version of the GTC is always published on the e-shop website.
